Q: Why can't residents park on one side of the streets?
A:  Deed restrictions aside, it is against the law because all public streets within Pasco county are "No Parking".  The Pasco county Sheriff will issue a parking ticket.  If you know you are going to have company for a gathering then you can download this Pasco county parking permit form and submit it at the government office in New Port Richey or mail it in to acquire a parking permit for your company.

Q: Why can we not use Cypress mulch for our plant beds?
A:  The ARB and the Board of Directors decided to not use the cypress mulch because of environmental reasons listed in this pamphlet as well as the fact that every home in Ashley Lakes should have had Pine Bark and not Cypress as the board has been informed by a representative of Centex.  This does not mean that they are responsible for replacing it, but rather they wish they had done it differently and have done so at their other new developments.

Q: What is SWFWMD and what can be done in SWFWMD?
A:  SWFWMD (Southwest Florida Water Management District) is the entity that helps to protect our precious wetlands.  Within Ashley Lakes all the ponds have a 15-25ft. buffer zone.  You can mow and trim up to this  but the buffer zone will be cut and controlled by a licensed company.  This means that you cannot build, mow, plant flowers/landscaping or dump yard/household waste in this buffer zone.  These areas are common areas owned by Ashley Lakes, not the individual homeowners, and must remain clear of obstructions that would prevent mowing equipment free passage.  The HOA will have any and all obstructions removed from these areas and assess the homeowners any charges incurred by doing so.

Q:  Can we have gates installed at the entrances of Ashley Lakes?
A:  No.  Our streets are county roads and the county will not allow this.  If by chance we finally got the approval for them, the cost would prohibit us from installing them.  The median cost of a decent gate would be around $55,000.00 ea. and then there would have to be extra liability insurance for any damages caused by the gates as well as regular maintenance and repairs and electricity.    

Q:  Can we have speed bumps installed within Ashley Lakes?
A:  Pasco county does not allow speed bumps on any public roads.  We have had a traffic study performed in the month of September 2006 and the Sheriff states that we do Not have a significant amount of speeding along Vanderbilt.  However, they are coming out now and ticketing people speeding through the subdivision as of October 2006.  The next step would be "speed cushions" which the owners on that particular street would be responsible for petitioning for and paying for.  If you would like more information on this please email David Greenblott at D.Greenblott@ashleylakes.com

Q:  Can we change any of the deed restrictions?  How?
A: Yes the deed restrictions can be altered as far as Exhibit C.  However, it must be done so by a vote of the homeowners.  The required number of homeowner that would need to vote is 67% or 204 homeowners, in order to meet the mandatory quorum.  Then the change must be recorded by our attorney with the county.

Q: What is the process for residents that do not adhere to the deed restrictions?
A:
Two letters are sent to residents to rectify any violation that they were notified of.  When the 3rd letter is sent and the homeowner has not made the correction to the problem the letter will notify them to remedy the situation or the legal fees for getting the attorney involved will be the responsibility of that homeowner.  An addendum will be attached to the 3rd letter that they have 30 days to pay the fee.  This fee will be stated as being no less than $140.00. 
Keep in mind that the deed restrictions in place currently are the same ones that Centex handed over February 28th, 2006.  Therefore, anyone that purchased their home from Centex signed a contract acknowledging that they had read their homeowners Documents and Deed Restrictions and agreed to adhere to those rules.  This was a requirement when signing the contract to build your home.
